Law 244 Television Law
This course reflects an integrated approach to the television industry, and the role of lawyers and legal doctrine within it. The course will be divided into three units, corresponding to transactional, policy/regulatory, and litigation-oriented practices in television law. In the transactional unit, we will cover dealmaking norms in connection with the development, financing, production, and distribution of television content. In the policy/regulatory unit, we will examine the role of Congress and various federal agencies and departments (such as the FCC, FTC and the US Department of Justice) in establishing and enforcing policies and regulations governing the industry. In the litigation unit, we will examine cutting-edge doctrinal legal issues, as well as long-standing areas of conflict, dominating the headlines (and dockets) around the television industry. Throughout all three units, the course will focus on new challenges faced by the industry in response to the recent (and ongoing) paradigm shift to digital production and distribution, with an emphasis on the role of lawyers in shaping current and future practice and policy, and the challenges of reconciling contemporary technologies and business practices with long-standing legal doctrine. Prior coursework in intellectual property and First Amendment law is not required, but is highly recommended.
